Service Testing Policy

This Use Policy (hereinafter – the "Use Policy") is an integral part of the rules for testing TrueConf software products and applies both upon acceptance of the testing terms on the website ai.trueconf.com (hereinafter - the "Site"), and upon acceptance within any part of the TrueConf software compatible with the product under test.

Definitions

  • Site Administration is the person(s) responsible for configuration and deployment of the services, maintenance, features, content, and interaction with users. The Site Administration is also the owner of the Site domain.
  • Server Administrator is the person(s) administrating the video conferencing server involved in the testing of the software which is a part of the service provided on the Site. (for example, the administrator of LLC “...”, which purchased the TrueConf Server software and installed it on its machines).
  • Developer is the entity developing the software which is a part of the Service that provides access to this software. The software is executed directly at the place of accepting these terms. For example, the terms are placed within the TrueConf Server software; agreement with the rules is a mandatory condition for connection and initiation of data exchange between the software installed by LLC “...” and the service under test.
  • Service is a set of features designed for data exchange between servers of third parties (legal entities using the TrueConf videoconferencing system capable of interacting with the Developer's software), this Site, and the Developer's software. The Service provides the features specified on the Site or in a different source.
  • User is a person who visits the site or is using a client application connected to the videoconferencing system. A User may also be the representative of the legal entity.

1. GENERAL PROVISIONS

TRUECONF grants End User the following rights, subject to End User's compliance with all terms and conditions of this EULA:

1.1. The Service is provided free of charge at the moment when these terms are accepted.

1.2. The Service is provided solely for informational and auxiliary purposes.

1.3. The Service is intended for testing the Developer’s software.

1.4. The testing is carried out on a non-commercial basis, and is intended exclusively to introduce users to the Developer’s software. It does not impose any obligations on the Site Administration and/or the Developer, and is conducted on an "AS IS" basis with a disclaimer of any liability by the Developer and the Site Administration.

1.5. This Use Policy applies only to the Service named directly on the Site or at the place of acceptance, for example, in the “Connection” → “TrueConf AI Server” section of the TrueConf Server (server part) software. The Site and/or the Site Administration and/or the Developer do not control and are not responsible for third-party websites that the User may access via the links available on the Site.

1.6. Testing is performed exclusively by the Server Administrator, namely by approving the connection of their video conferencing server to %server_name_ai. By default, the feature is disabled; thus, testing is carried out upon explicit acceptance of the terms by the Server Administrator, who, in turn, is a representative authorized to make such a decision. The respective legal entity is obliged to independently control the authority of persons performing such administrative actions. Possession of server administrator access is perceived as the ability and right of the Server Administrator to participate in testing on behalf of the legal entity owning the video conferencing server. In the absence of such authority, the Server Administrator is obliged to obtain it or refrain from testing.

2. WEBSITE USE TERMS

2.1. The User agrees to use the Service in accordance with this Policy, applicable law, generally accepted business practices, and generally accepted ethical standards.

2.2. The User is fully responsible for the content and nature of the information sent to the Site/Service (including, but not limited to, voice messages or files). The Developer and the Site Administration do not review information sent from third-party servers; processing is carried out automatically for the purpose of testing the software. The information processed by the software will not be made available on any public resources or on the Developer's resources, but may be accessible in the videoconferencing software used by the owner of the video conferencing server.

2.3. The User is prohibited from providing or transmitting any personal data and any other information whose protection is guaranteed by applicable information and personal data protection laws, including, but not limited to, information constituting commercial, banking, tax, or other legally protected secrets, and any information that is valuable or confidential. The owners of the servers, access to which is provided by the Server Administrator, are obliged to ensure that Users comply with the prohibition of exchanging confidential information through this Service. If a User violates this provision, this person must cease using the service and notify the Developer, the server owner, the Site Administration, and the Server Administrator of this violation.

2.4. The Service and the Site are not intended for processing, storing, or transmitting information classified as legally protected.

3. INFORMATION AND CONFIDENTIALITY

3.1. The Site and the Service do not intentionally process personal data of Users and/or third parties. Any data that may be automatically transmitted during the operation of the Service (including IP address, cookies, technical parameters of equipment, access time, and other information) is used solely for technical purposes to ensure the operation of the Service, and is not processed to identify a User.

3.2. All processing of data received from third-party servers is carried out automatically without the participation of the Site Administration or the Developer. The Developer does not store, systemize, and/or use data for the purposes that are not related to the testing of the software.

3.3. The User and/or the Server Administrator are fully responsible for the content and nature of the data transmitted during testing. The Site Administration and the Developer are not obliged to verify, analyze, or control such data and are not responsible for its accuracy, confidentiality, or legality of transmission.

3.4. If the User or the Server Administrator believes that information subject to commercial, banking, official, or other secrecy is being transmitted during testing, they must immediately stop using the Service and notify the Site Administration.

3.5. Connection of the video conferencing server to the product under test is carried out solely at the initiative and with the consent of the Server Administrator.

3.6. The Server Administrator confirms that they have all necessary authority from the legal entity (the server owner), and assumes full responsibility for the consequences of using the Service, including the possible transmission of data.

4. LIABILITY OF THE PARTIES

    4.1. The Site, the Developer, and the Site Administration are not liable for:
  • Losses, direct or indirect, arising from the use or inability to use the Service
  • Correctness, completeness, reliability, or suitability of the results provided by the Service.
  • Safety, integrity, or confidentiality of the data transmitted by Users or received from third-party servers
  • Any actions or omissions of Users, Server Administrators, or third parties
  • Any law violation by a User or the Server Administrator when using the Service.

4.2. The Service is provided on "AS IS" basis, without any warranties regarding its uninterrupted operation, accuracy of results, fitness for a particular purpose, or ability to match Users’ expectations.

4.3. The Site Administration reserves the right to suspend, modify, or terminate the provision of the Service at any time without prior notice and without any liability to Users.

4.4. In the event of a violation of this Policy by a User and/or the Server Administrator, which resulted in losses or other consequences for the Developer or the Site Administration, the liable party shall compensate for such losses in full.

4.5. The Service is provided solely for testing purposes and is not intended for production use.

4.6. The results generated during testing (including transcripts, meeting minutes, and other materials) are not to be used for business, management, legal, or other purposes requiring data accuracy and reliability.

4.7. The Developer and the Site Administration do not guarantee the compatibility of the Service with the User's server software, the correctness of audio stream processing, or preservation of the results.

4.8. The customer, i.e., the owner of the video conferencing server (a legal entity), is the sole entity determining the purposes and means of data processing, and bears the status of the data controller in accordance with applicable data protection laws.

5. DISPUTE RESOLUTION

5.1. All disputes and disagreements arising from the use of the Site or the Service shall be resolved by sending a written claim to the Site Administration.

5.2. The claim review period is 30 (thirty) calendar days starting from the moment when the claim was received.

5.3. If no agreement is reached, the dispute shall be referred to a competent court at the place of registration of the Site Administration and shall be governed by the applicable law of the country where the Site Administration is registered.

5.4. If the data, which is protected by law, is transmitted or processed, responsibility for the consequences of such transmission rests entirely with the party that initiated the connection (the Server Administrator and/or the User).

5.5. The Developer and the Site Administration are not obliged to take measures to protect such data if it was transmitted in violation of the terms of this Policy.

5.6. The relations arising from this Policy are governed by the applicable law of the country of the Developer's registration, unless otherwise expressly provided by a separate agreement between the parties.

6. ADDITIONAL TERMS

6.1. The Site Administration has the right to amend this Use Policy at any time without any prior notice to Users.

6.2. The new version of the Policy comes into force from the moment of its publication on the Site or at any other place where the terms of testing are accepted, unless otherwise specified in the amended text.

6.4. The Developer and the Site Administration act solely as a technical intermediary, ensuring data transfer between systems, without access to the content and without the ability to influence it, except for deleting the information without disclosing or viewing it etc.

6.5. The use of the Service does not create relationships between the User, the Server Administrator, and the Developer in the context of personal data legislation.

6.6. The Developer and the Site Administration do not act as data controllers or data processors in relation to information transmitted during testing.

6.7. The use of the Service for testing implies the unconditional agreement of the User and the Server Administrator that the Developer and the Site Administration are not responsible for any direct or indirect losses, including, but not limited to: data loss, breach of confidentiality, information distortion, malfunctions in hardware or software.

6.8. This Service is intended exclusively for legal entities and is not an offer of services to consumers, nor is it intended for use by individuals for personal (consumer) purposes.

6.9. The Developer is not a data controller or data processor within the meaning of applicable personal data legislation, including the GDPR, and has no influence on the content of the transmitted data, and is not obliged to store data.
